Introduction To Templates & Documents
The documents on the following pages contain templates and information developed by Drs. Platto and Sosine to help QMEs organize and develop information critical to performing QME medical-legal evaluations that are both comprehensive and meet the standard of evidence for report admissibility.
The templates provided below may be altered or modified to meet your particular needs as a QME with regard to your discipline and specialty. However, the information contained in the templates will help to ensure that all important, necessary and critical information regarding the case being evaluated is available to the QME for report inclusion.
Also, while there are many case laws that have evolved in California in recent decades, the four most important workers’ compensation case laws in recent years that both attorneys and insurance carriers frequently advise QMEs must be considered and addressed in their reports, depending upon the relevance and applicability of such case laws to the case being evaluated. These case law summaries are not intended to take the place of reading the entirety of each case law, as determined by the WCAB (Workers’ Compensation Appeals Board). However, these brief summaries will provide the QME with a relatively quick understanding of the intent and decisions under such judicial decisions. Remember, case law is established upon re-consideration of one or more disputed issues in a case by a panel of three WCAB judges. When case law is established, it in fact becomes the law and can only be overturned or modified by the State legislature or the State supreme court.
